This royalty is payable on the gross tonnage of material extracted. This royalty interest shall be held by the Sellers, and their heirs and assigns, in perpetuity for the full commercial duration of the mining operation on the subject parcel. The sale is contingent upon the execution of a separate legal Mining Royalty Agreement as per the attorneys drafting that fully details the measurement, reporting, and payment schedule of the retained royalty interest.
